القضاء في عهد الخلافة الراشدة يُعد أول تجربة قضائية للمسلمين بعد نبيهم صلى الله عليه وسلم ولئن تميّز عهد النبوة بالوحي الذي هو مصدر التشريع ، وبوجود النبي صلى الله عليه وسلم قائماً بأمر الحكم بين الناس ومتولياً لهذا الشأن بتسليم ورضى وانقياد منهم تحقيقاً لما أمروا به في مثل قوله تعالى : (إنما كان قول المؤمنين إذا دعوات إلى الله ورسوله ليحكم بينهم أن يقولوا سمعنا وأطعنا وأولئك هم المفلحون) النور 24/51. فان عهد الخلفاء الراشدين هو المرحلة التطبيقية للقضاء تأسيساً على نصوص الشريعة ، وتأصيلاً للأحكام على ما فهم من سنن الرسول الكريم صلى الله عليه وسلم في هذا الباب من بعده. كما يظهر في هذه المرحلة الطريقة الصحيحة للنظر والاجتهاد في أعيان الحوادث المستجدة في واقع الناس ولم يكن لها نص يخص آحادها من المشرّع ، فيتحقق قيام المقتضي لاستخراج العلل وتحقيق المناطات واستجلاء الأقيسة السالمة من العوارض والنواقض.
